{"id":40,"date":"2007-08-23T14:14:02","date_gmt":"2007-08-23T21:14:02","guid":{"rendered":"http:\/\/elbertcounty.net\/blog\/archives\/40"},"modified":"2007-09-15T10:15:28","modified_gmt":"2007-09-15T17:15:28","slug":"emtala","status":"publish","type":"post","link":"https:\/\/elbertcounty.net\/blog\/2007\/08\/emtala\/","title":{"rendered":"EMTALA"},"content":{"rendered":"<p><!--more--><\/p>\n<p><a href=\"http:\/\/en.wikipedia.org\/wiki\/Emergency_Medical_Treatment_and_Active_Labor_Act\">Emergency Medical Treatment and Active Labor Act<\/a><\/p>\n<p>The <strong>Emergency Medical Treatment and Active Labor Act<\/strong> (<a href=\"http:\/\/en.wikipedia.org\/wiki\/Title_42_of_the_United_States_Code\" title=\"Title 42 of the United States Code\">42 U.S.C.<\/a>\u00a0<a rel=\"nofollow\" href=\"http:\/\/www.law.cornell.edu\/uscode\/42\/1395dd.html\" title=\"http:\/\/www.law.cornell.edu\/uscode\/42\/1395dd.html\" class=\"external text\">\u00a7\u00a01395dd<\/a>, <strong>EMTALA<\/strong>) is a <a href=\"http:\/\/en.wikipedia.org\/wiki\/United_States\" title=\"United States\">United States<\/a> <a href=\"http:\/\/en.wikipedia.org\/wiki\/Act_of_Congress\" title=\"Act of Congress\">Act of Congress<\/a> passed in 1986 as part of the <a href=\"http:\/\/en.wikipedia.org\/wiki\/Consolidated_Omnibus_Budget_Reconciliation_Act\" title=\"Consolidated Omnibus Budget Reconciliation Act\">Consolidated Omnibus Budget Reconciliation Act<\/a>. It requires <a href=\"http:\/\/en.wikipedia.org\/wiki\/Hospital\" title=\"Hospital\">hospitals<\/a> and <a href=\"http:\/\/en.wikipedia.org\/wiki\/Ambulance\" title=\"Ambulance\">ambulance<\/a> services to provide care to anyone needing emergency treatment regardless of <a href=\"http:\/\/en.wikipedia.org\/wiki\/Citizenship\" title=\"Citizenship\">citizenship<\/a>, legal status or ability to pay. There are no reimbursement provisions; as a result of the act, patients needing &#8220;emergency&#8221; treatment can be discharged only under their own informed consent or when their condition requires transfer to a hospital better equipped to administer the treatment. EMTALA applies only to &#8220;participating hospitals&#8221; which accept payment from the Department of Health and Human Services, Centers for Medicare and Medicaid Services (CMS) under the Medicare program. In practical terms, it applies to virtually all hospitals in the U.S., with the exception of the Shriners&#8217; Hospital for Crippled Children, Indian Health Services and military VA hospitals.
