Section 24-10-109 on July 17, 2007, for a claim of wrongful termination by Sheriff William Frangis.<span>\u00a0 <\/span>Mr. Sherman\u2019s claim states he was \u201cterminated for his refusal to participate in and sanction the secretive and inappropriate alleged activities carried out in the Office of the Sheriff and by Sheriff Frangis including, but not limited to:<\/span><\/span><\/p>\n<blockquote><p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(1) the improper handling in the chain of evidence in a crime, including the falsification of investigative reports and knowingly filing the same with command to evaluate and decided if further action need been performed, i.e., sending to the investigative bureau of the department.<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(2) improper conduct and viewing of strip searched female prisoners;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(3) poaching from a vehicle;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(4) falsification of probable cause in order to stop and ultimately apprehend individuals and vehicles;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">[list misnumbered in the original &#8211; no number 5]<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(6) targeting and waiting outside establishments that sold liquor to patrons to issue alcohol related charges to both the individual and the establishment;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(7) drinking while on the job by sheriff personnel;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(8) falsification and improper issuance of the concealed gun permit program; and,<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(9) illegal driving by sheriff personnel, including Sheriff Frangis;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(10) ineffective training procedures for new recruits in the field or for those transferring to other departments;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(11) lack of continuity in case follow-up;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(12) arbitrary and unilateral demotions and\/or reassignments given in the field by personnel not authorized to do so;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(13) punitive action taken when telling a civilian the proper channels in which to file a grievance against an officer;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(14) inability to have a case properly investigated to determine the correct outcome (not just assuming facts not in evidence);<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(15) the makings of derogatory, inflammatory and slanderous remarks against certain individuals in the department in an effort to use the derogatory information to determine or evaluate a pending criminal case;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">[list misnumbered in the original &#8211; no number 16]<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(17) withholding pertinent and important information concerning an ongoing criminal investigation by individuals in the higher ranks of command, i.e. Lt. Underwood and Sgt. Mattive;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(18) the sabotaging of a pending criminal case by having a rookie patrol deputy interview important and possible suspects in a criminal investigation;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(19) the continued undermining of pending criminal cases which were being investigated by Mr. Sherman;<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(20) failure of field training officers (FTO) to properly monitor, advise, correct and\/or sign off on any reports and\/or investigations of any probationary investigators or field agents.<\/span><\/p>\n<p><span style=\"font-family: Georgia\"><\/span><span style=\"font-family: Georgia\">(21) a violation of Mr. Sherman&#8217;s civil rights as an Hispanic American.<\/span><font face=\"Courier New\">\u00a0<\/font><\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"nf_dc_page":"","_genesis_hide_title":false,"_genesis_hide_breadcrumbs":false,"_genesis_hide_singular_image":false,"_genesis_hide_footer_widgets":false,"_genesis_custom_body_class":"","_genesis_custom_post_class":"","_genesis_layout":"","footnotes":""},"categories":[4],"tags":[],"class_list":{"0":"post-4","1":"post","2":"type-post","3":"status-publish","4":"format-standard","6":"category-elbert-county-sheriff","7":"entry"},"_links":{"self":[{"href":"https:\/\/elbertcounty.net\/blog\/wp-json\/wp\/v2\/posts\/4","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/elbertcounty.net\/blog\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/elbertcounty.net\/blog\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/elbertcounty.net\/blog\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/elbertcounty.net\/blog\/wp-json\/wp\/v2\/comments?post=4"}],"version-history":[{"count":0,"href":"https:\/\/elbertcounty.net\/blog\/wp-json\/wp\/v2\/posts\/4\/revisions"}],"wp:attachment":[{"href":"https:\/\/elbertcounty.net\/blog\/wp-json\/wp\/v2\/media?parent=4"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/elbertcounty.net\/blog\/wp-json\/wp\/v2\/categories?post=4"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/elbertcounty.net\/blog\/wp-json\/wp\/v2\/tags?post=4"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
