The entire video is here:<\/p>\n<p><iframe loading=\"lazy\" src=\"\/\/www.youtube.com\/embed\/C3STNznLbE8\" frameborder=\"0\" height=\"300\" width=\"522\"><\/iframe><\/p>\n<p>COGCC and COGA raised a number of objections about the proposed zoning regulations as follows:<\/p>\n<p>(Each of the links in this list starts the video at the relevant point.\u00a0 You might want to open them in a separate tab.)<\/p>\n<blockquote>\n<ul>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=23m10s\">The MOU is a vehicle for you to negotiate things which you cannot mandate<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=26m43s\">Operational conflicts in general<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=36m56s\">The MOU is NOT the entire agreement for expedited CDS approval<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=39m14s\">The community meeting requirements are redundant of state regulations<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=44m30s\">If you want to have a completely duplicative process (with COGCC), you can<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=45m05s\">Page 14 dust control measures with produced water.\u00a0 Operational conflict with COGCC rule 910.<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=49m04s\">Hazardous material inventory statement undefined and potentially conflicting with COGCC.<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=50m05s\">All weather surface on private property undefined.\u00a0 COGCC recommends this be in MOU.\u00a0 Fire Depts. want it regulatory.\u00a0 Not resolved.<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=53m01s\">Disposal of produced water section thoroughly regulated by COGCC.\u00a0 Operational conflict. <\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=54m35s\">There is no presumption against open pit storage at COGCC.\u00a0 Operational conflict.<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=1h54s\">COGCC regulates produced water pits used by multiple operators<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=1h05m45s\">Permit time frame for removal of operational equipment conflicts with COGCC interim reclamation.<\/a><\/li>\n<li><a href=\"http:\/\/www.youtube.com\/watch?v=C3STNznLbE8&amp;feature=youtu.be&amp;t=1h15m20s\">Most counties are not using an MOU legal structure.\u00a0 Most rely on COGCC LGD interface.<br \/>\nCOGA &#8211; &#8220;We&#8217;re not seeing this is the norm by any case.&#8221;<\/a><\/li>\n<\/ul>\n<\/blockquote>\n<p>The proposed oil &amp; gas zoning regulations and MOU, both dated May 10, 2013, were subsequently sent to the BOCC for approval <strong><em>without<\/em><\/strong> any of the above cited operational conflicts and other problems addressed.<\/p>\n<p>As of this writing on 7-13-2013 they are still on-line at the county website at:<\/p>\n<blockquote><p><a href=\"http:\/\/www.elbertcounty-co.gov\/documents\/editsOil%20and%20gas%20regs%20%20edits%205-10-13%20.pdf\" target=\"_blank\">Oil &amp; Gas Regulations \u2013 Draft<\/a><\/p>\n<p><a href=\"http:\/\/www.elbertcounty-co.gov\/documents\/MEMORANDUM%20OF%20UNDERSTANDING%20OG%205-10-2013%20Final%20%28no%20comments%29%20%282%29.pdf\" target=\"_blank\">Memorandum of Understanding OG \u2013 Draft<\/a><\/p>\n<p>Note: Copies saved <a href=\"http:\/\/elbertcounty.net\/blog\/wp-content\/uploads\/2013\/07\/editsoil-and-gas-regs-edits-5-10-13.pdf\" title=\"here\">here<\/a> and <a href=\"http:\/\/elbertcounty.net\/blog\/wp-content\/uploads\/2013\/07\/memorandum-of-understanding-og-5-10-2013-final-no-comments-2.pdf\" title=\"here\">here<\/a>.<\/p><\/blockquote>\n<p>It would appear that Rowland and Schlegel paid attention this day, and Ross did not.\u00a0 Knowing that <em>none of these concerns had been addressed in the draft documents<\/em>, Rowland and Schlegel subsequently ruled on them in the only reasonable way they could have.<\/p>\n<p>Why did the oil &amp; gas edit committee and the CDS department not respond to the COGCC warnings?<\/p>\n<p>Why did the planning commission accept documents they knew had been made obsolete by COGCC criticisms?<\/p>\n<p>Why did the edit committee, the planning commission, and the CDS department, try to convince the BOCC to put Elbert County on a litigation collision course with the state?<\/p>\n<p>Should there be wholesale changes in personnel in all of these groups?<\/p>\n<p>How can the citizens of Elbert County trust future advice from the people currently operating these groups?<\/p>\n<p>B_Imperial<\/p>\n<blockquote><\/blockquote>\n<blockquote><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>On May 14th, representatives from COGCC and COGA met with the BOCC, members of the CDS department, and Grant Thayer representing the proposed oil &amp;
