{"id":3393,"date":"2013-03-21T21:13:46","date_gmt":"2013-03-22T04:13:46","guid":{"rendered":"http:\/\/elbertcounty.net\/blog\/2013\/03\/21\/transparency\/"},"modified":"2013-03-23T08:46:02","modified_gmt":"2013-03-23T15:46:02","slug":"transparency","status":"publish","type":"post","link":"https:\/\/elbertcounty.net\/blog\/2013\/03\/transparency\/","title":{"rendered":"special district approval transparency?"},"content":{"rendered":"<p>The <a href=\"http:\/\/elbertcounty.net\/blog\/wp-content\/uploads\/2013\/03\/draft-special-district-reg.pdf\">proposed zoning law<\/a> (General Standards of Approval) duplicates much of the approval criteria contained in <a href=\"http:\/\/elbertcounty.net\/blog\/wp-content\/uploads\/2013\/03\/crs-32-1-203.pdf\">state statute<\/a>.  Such duplication would appear to be unnecessary and needlessly expensive to maintain.<\/p>\n<p>In addition, the thrust of CRS 32-1-203 appears to contemplate a service plan decision made at a <em>public hearing<\/em> by a BOCC where opposed views can be openly discussed.<\/p>\n<p>The proposed zoning law seems to remove the evaluation of new special districts to off-line Review Committees who do not operate in public hearings and whose findings cannot be challenged in public by petitioners.<!--more--><\/p>\n<p><a href=\"http:\/\/elbertcounty.net\/blog\/wp-content\/uploads\/2013\/03\/crs-32-1-203.pdf\" title=\"C.R.S. 32-1-203\">C.R.S. 32-1-203<\/a><\/p>\n<blockquote><p>32-1-203. Action on service plan &#8211; criteria<br \/>\n(1) The board of county commissioners of each county which has territory included within the proposed special district, other than a proposed special district which is contained entirely within the boundaries of a municipality, shall constitute the approving authority under this part 2 and shall review any service plan filed by the petitioners of any proposed special district.<br \/>\n<strong>(4) The findings of the board of county commissioners shall be based solely upon the service plan and evidence presented at the hearing by the petitioners, planning commission, and any interested party.<\/strong><\/p><\/blockquote>\n<p><a href=\"http:\/\/elbertcounty.net\/blog\/wp-content\/uploads\/2013\/03\/draft-special-district-reg.pdf\" title=\"PROPOSED SPECIAL DISTRICT REGULATIONS\">PROPOSED SPECIAL DISTRICT REGULATIONS<\/a><\/p>\n<blockquote><p>6. Pre-Application Review. Referral agencies shall include any service district within three miles of the proposed Special District. The consultants and referral agencies will have 21 days to respond with comments to CDS in writing. A Referral Agency may request an additional ten [10 ] days if needed. Comments that require a written response from the Applicant will be forwarded when received. Such written responses shall be submitted to CDS and forwarded to the referral party for verification<br \/>\na. Community &amp; Development Services shall:<br \/>\n\u00b7 Review for general completeness of information,<br \/>\n\u00b7 Distribute referral copies to Review Committee members and other referral entities for comments,<br \/>\n\u00b7 Review the Special District proposal for County impact and<br \/>\n\u00b7 Coordinate referral comments to Applicant.<br \/>\nb. The Pre-Application Service District Plan shall be reviewed by the <strong>Elbert County Review Committee<\/strong> as follows:<br \/>\n\u00b7 Community &amp; Development Services<br \/>\n\u00b7 Finance professional<br \/>\n\u00b7 Engineering<br \/>\n\u00b7 Legal<br \/>\n\u00b7 Elbert County Water Advisory Committee &amp; Water consultant as required<br \/>\n\u00b7 Other professionals and Referral agencies as may be deemed necessary.<br \/>\nc. Review Committee professionals shall be expected to review the information relative to their professional expertise and respond in writing to CDS about:<br \/>\n\u00b7 Completeness of information,<br \/>\n\u00b7 Validity of assumptions,<br \/>\n\u00b7 Being factually correct,<br \/>\n\u00b7 Identifying risks to Health, Safety, &amp; Welfare of Elbert County and<br \/>\n\u00b7 Professional experience \/ opinion related to project feasibility for the greater good of Elbert County citizens.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>The proposed zoning law (General Standards of Approval) duplicates much of the approval criteria contained in state statute.
